Terms of Service

By accessing and using DistressIQ ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

DistressIQ provides real estate distress signal monitoring, lead scoring, and contact enrichment tools for real estate professionals. The Service is intended for lawful business use only.

Skip trace credits are non-refundable. Contact data is delivered instantly upon request and cannot be "returned." By purchasing skip trace credits, you acknowledge:

1. Contact information is sourced from third-party databases and public records.
2. We do not guarantee the accuracy, completeness, or currency of any contact information provided. While we strive for the highest possible match rates, some records may be outdated, incomplete, or inaccurate.
3. You are solely responsible for compliance with all applicable laws regarding the use of contact information, including but not limited to the Telephone Consumer Protection Act (TCPA), state Do-Not-Call laws, and CAN-SPAM Act.
4. DNC (Do Not Call) flags are provided for informational purposes. It is your responsibility to maintain your own DNC compliance.
5. Skip trace results are for your use only and may not be resold, redistributed, or shared outside your organization.
6. Bulk trace operations are final once initiated and cannot be cancelled mid-process.

You are responsible for maintaining the security of your account credentials. All activity under your account is your responsibility.

Skip trace credits never expire. Subscription fees are billed on a recurring basis as described at the time of purchase.

Chargebacks or payment disputes on skip trace credit purchases may result in immediate account suspension and forfeiture of remaining credits.

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, scrape, or systematically extract data from the Service
• Share, resell, or redistribute data obtained through the Service
• Create multiple accounts to circumvent usage limits
• Use contact information obtained through the Service for harassment or illegal solicitation

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. IN NO EVENT SHALL DISTRESSIQ BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
